We will ensure that all placements are made in accordance with any relevant legislative requirements.

The Privacy Act 1988 sets no minimum age at which an individual can make decisions regarding his or her personal information. The Guidelines to the National Privacy Principles 68.18 suggest that each case must be considered individually, and give guidance as to when a young person may have the capacity to make a decision on his or her own behalf. The specific right of privacy for children also is set out in Article 16 of the United Nations Convention on the Rights of the Child 1989, coming into effect in Australia in January 1991.
